Important News on Maryland’s Family and Medical Leave Insurance (FAMLI) Program

Maryland has opened the employer registration for the Family and Medical Leave Insurance (FAMLI) program. All Maryland employers must register and the state requires an authorized officer of your business to create the account and complete identity verification. Because of this requirement, your business must complete the registration directly. You can register here.
An authorized officer is an owner, officer, or another individual legally permitted to act for the business. They will need:
- An email address and phone number, or an existing Login.gov account
- A Social Security number and driver’s license or state ID for identity verification
- Your federal EIN, legal business name, any trade name, NAICS code, physical and mailing addresses, and business email address
- The authorized officer’s name, job title, work email, and work phone
- Your resident agent’s name, physical address, email, and phone number
After registration, the next steps depend on how your payroll is processed.
If BMC processes your payroll through Patriot Software:
As we get closer to January, you will receive an email from FAMLI asking your authorized officer to authorize Patriot Software as a third-party agent on your account. This authorization allows quarterly wage and hour reports to be filed and contributions to be remitted on your behalf. Your authorized officer will need to sign a Power of Attorney within the FAMLI portal to accept the request.
Please complete this promptly. The invitation expires 30 days after it is sent. If it expires, let us know and we will have it sent again.
Beginning with your first payroll in January 2027, we will withhold the employee share of FAMLI contributions and account for any employer share that applies. You will not need to calculate the amounts or change how you submit payroll to us.
If you process payroll in-house or use another payroll provider:
Please contact the person or company that processes your payroll before your first January 2027 payroll. Contributions begin with wages paid on and after January 1, 2027, so FAMLI withholding must be set up in advance.
Please ask your provider:
- Will FAMLI withholding be active for our first payroll in January 2027?
- Do you need third-party agent access to our FAMLI account to file quarterly reports and remit contributions?
If your provider needs third-party agent access, your authorized officer will receive an email from FAMLI and must sign a Power of Attorney within the portal to authorize it. This invitation also expires after 30 days.
If you run payroll in-house, you will be responsible for filing quarterly wage and hour reports and remitting contributions through the FAMLI portal. The first report and payment, covering the first quarter of 2027, are due April 30, 2027.
Every employer that registers is automatically enrolled in Maryland’s State Plan. No additional action is needed if you intend to remain in that plan. If you are considering a private plan, Maryland requires a Declaration of Intent by November 15, 2026, along with proof that you consulted a licensed insurance agent. Please let us know before then, as a private plan affects how January payroll must be set up.
